Successful Defense of Negligence Claims
Konowitz & Greenberg recently successfully defended a professional tennis player in a negligence suit filed against him. In the case, O'Brien v. Econo-Tennis Management Corporation, the plaintiff alleged she had been injured during a tennis lesson with our client, and that her injuries were, in part, a result of our client's negligence. After the completion of discovery, and while a motion for summary judgment was pending in the Middlesex County Superior Court, the parties agreed to mediate the case. After settling her claims against a co-defendant in the case, who K&G did not represent, the plaintiff agreed to the dismissal of her claims against the tennis pro, with our client paying no money to the plaintiff.
